Selling an inherited, probate or estate home

Clearing title, preparing the house and selling it, alongside your attorney, for heirs, executors and trustees.

Why an inherited home isn't ready to sell yet

Most families assume they can list a parent's home the week after the funeral. Then the title company searches the records, sees the last deed still in the name of someone who has passed away, and the sale stops. A title company won't insure a sale until ownership has been legally moved to the people selling, and that transfer is recorded with the county.

Texas offers several paths to get there. Which one fits depends mostly on whether there was a valid will and whether the estate has debts. Some are faster and cheaper than others. Muniment of title, for example, is often the quickest route when there's a will and no debts beyond the mortgage.

I'm a broker, not an attorney or a CPA. Probate and estate taxes are legal and tax questions, so the first call should be to a Texas probate attorney. The second one can be to me, so the house is ready to go when the paperwork is.

How I help heirs, executors and trustees

  • Working alongside your attorney so the listing, the contract and the closing follow what the estate or trust requires.
  • Clearing out a long-held house. Estate sales, sorting what the family wants to keep, and coordinating haul-off for the rest.
  • Preparing the house without overspending. Inherited homes are often dated. I'll tell you what's worth doing before listing and what to leave for the buyer.
  • Keeping every heir informed, including the ones who live out of state, so decisions don't stall waiting on someone who hasn't heard the latest.

One example was a family home of more than 30 years in Spicewood Estates. Candi Stanley interviewed several agents before choosing. In her words: "It was no contest, James became the listing agent, and the professionalism, enthusiasm, communication never waned." We ran the estate sale and worked through every quirk of probate together.

What you get

The same full plan every seller gets, laid out on how I sell a home: pricing with three plans, professional photos and video, ads that run until the home sells, a Grand Opening open house, and a Monday Morning Market Update on the home every week. On an estate sale, those weekly updates are often what keeps a family in agreement.

Frequently Asked Questions

Can we list the house before probate is finished?

Often you can prepare and even list, but the sale can't close until the transfer of ownership is complete and recorded. Your probate attorney can tell you what your situation allows.

What is muniment of title?

A Texas court process that admits a will to probate as proof of who now owns the property, without a full administration. It's often the fastest path when there's a valid will and no debts beyond the mortgage. Ask your attorney whether it fits.

Do you help with the estate sale and clean-out?

Yes. I coordinate estate sales, sorting and haul-off so the house is ready when the paperwork is.
