Selling a home during a divorce

A calm, even-handed sale when two owners have to agree, with both of you kept informed at every step.

When two owners have to agree

Selling a house during a divorce has all the usual pieces of a sale, plus one more: two owners who have to agree on every decision, often while they're not agreeing on much else. The price, the repairs, the showings, the offers. Each one is a decision that can stall.

The sale goes best when both owners see the same information at the same time, and when the agent is clearly working for the sale rather than for one side of it. That's how I approach it.

This page is general information. Texas is a community property state, and how a home is divided is a legal question for your attorneys and the court. I work alongside them, not in place of them.

How I keep the sale moving

  • The same information to both of you. Pricing, feedback, offers and updates go to both owners, so nobody hears about a decision secondhand.
  • Pricing you can both see the reasoning for. A real market evaluation and three pricing plans, laid out so the choice is about strategy, not about who wanted what. See how pricing works.
  • Working with both attorneys. Timing, who signs, and how proceeds are handled often come from the decree or the agreement. I make sure the sale follows it.
  • Calm, practical prep. When one owner has moved out, I help get the house ready without asking either of you to carry the whole load.

What you get

The same full plan every seller gets, from photos and video to ads that run until the home sells and a Monday Morning Market Update on your home every week. The difference is in how it's communicated: evenly, in writing, and without taking sides. For the full method, see how I sell a home.

I've helped sellers through this in the past year, and I know it's rarely only about the house. My job is to make the sale the simplest part of a hard season.

Frequently Asked Questions

Do both of us have to sign the listing agreement?

Usually both owners of record sign. The details can depend on your agreement or decree, so I confirm them with your attorneys before we list.

Who do you take direction from?

Both owners, equally. Everything I send goes to both of you, and decisions are made together or as your agreement or the court directs.

Is this legal advice?

No. I'm a broker, not an attorney. I work alongside your attorneys and follow what your agreement or decree requires.
